
BRANDS BEHAVING BADLY
This case has been ongoing since 2017 when Olaplex filed a lawsuit against L’Oreal, the untouchable giants in the hair game business.

ROOT >> of the problem
Olaplex created a bonding system, a multi-step process aimed at strengthen and protecting all hair types {including those like myself with afro, curly textured locks}.
Out of the blue~rinse~blue…. the following year L’Oreal just happened to miraculously come up with its own products with identical if not a blatant copycat to Olaplex’s.
DAMAGE
The trade secret misappropriation, patent infringement, and breach of contract lawsuit Olaplex has rinsed against L’Oreal.
⚖️ ARGUMENT
L’Oreal says the knowledge of Olaplex’s bad ass hair bonding products and what their claim is based upon was already available—out there publicly!! Nobody seems to have a whiff of this though {thought I would throw shade on the common knowledge gap}, and if they did it was kept seriously quiet {Ssshhh — not even a whisper surfaced}. Anyway—Olaplex called them out on every single level and the word ‘betrayal’ kinda surfaces in a loud whisper.
PUNISHMENT
A Judge of the U.S. District Court for the District of Delaware in the United States has spoken, and it goes like this:
• ordered that L’Oreal perm-anently pull 9 of its products from all shelves in the U.S.
• name of the products to be pulled: its Smart bond shampoo & conditioning kits {see pic} and any similar products from its Redken and Matrix brands.
REPAIR >> breakdown
The Judge decided on August 20th that the jury possibly awarded in excess and chopped off the $91 million damages award for Olaplex, by trimming the amount by half.
VERDICT >>August 2019
Olaplex is entitled to recover $25 million for the trade secret, patent infringement, and breach of contract claims, as well as another $25 million in connection with the jury’s finding that L’Oreal acted willfully in its violations of the law.
